Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you (whether personally or on behalf of an entity) and HytList ("we," "us," or "our") concerning your access to and use of the hytlist.org website and all related services, features, and content (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of the Service.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Service. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.

You must be at least 13 years of age to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

To access certain features, including server listing submission and voting, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account credentials
• Accept all responsibility for activity that occurs under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to refuse registration, suspend, or terminate accounts at our discretion, including for violations of these Terms.

Unless otherwise indicated, the Service and all content, features, and functionality (including but not limited to software, code, databases, text, graphics, logos, icons, images, and design) are owned by HytList and are protected by international copyright, trademark, and other intellectual property laws.

"Hytale" is a trademark of Hypixel Studios. This website is an independent, community-run platform and is not affiliated with, endorsed by, sponsored by, or associated with Hypixel Studios or Riot Games.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. This license does not include:

• Resale or commercial use of the Service or its content
• Collection and use of server listings, descriptions, or data
• Derivative use of the Service or its content
• Downloading or copying of account information for the benefit of another party
• Use of data mining, robots, or similar data gathering and extraction tools

4.1 Listing Submission

Server owners may submit their Hytale servers for listing on the Service. By submitting a server listing, you represent and warrant that:

• You own or have authorization to list the server
• All information provided is accurate and truthful
• Your server complies with all applicable laws and regulations
• Your server does not infringe on the intellectual property rights of others
• Your server content does not contain illegal, harmful, or offensive material

4.2 Content Guidelines

Server listings must not contain or promote:

• Illegal activities, piracy, or unauthorized game modifications
• Malware, viruses, or malicious code
• Hate speech, harassment, discrimination, or violence
• Adult content, pornography, or sexually explicit material
• Gambling or real-money trading that violates applicable laws
• Phishing, scams, or fraudulent schemes
• False or misleading information about server features

4.3 Moderation

All server submissions are subject to review and verification before appearing on the public listing. We reserve the right to approve, reject, remove, or modify any server listing at our sole discretion.

5.1 Voting Rules

• Users may vote for each server once every 24 hours
• Vote counts are calculated on a rolling 30-day basis for rankings
• Votes must be cast by legitimate users through our website interface
• One vote per user per server per 24-hour period

5.2 Vote Manipulation and Fraud

The following activities are strictly prohibited and will result in immediate action:

• Using bots, scripts, or automated tools to generate votes
• Creating multiple accounts to vote for the same server
• Using VPNs, proxies, or other methods to circumvent voting limits
• Purchasing votes or vote manipulation services
• Exchanging votes with other server owners ("vote trading")
• Incentivizing users to vote through deceptive means

Servers found engaging in vote manipulation will face penalties including vote resets, temporary suspension, permanent delisting, and account termination.

5.3 API Integration

We provide an API for server owners to verify votes and reward players. API access is subject to rate limiting (60 requests per minute). Abuse of the API may result in access being revoked.

You agree not to engage in any of the following prohibited activities:

• Violating any local, state, national, or international law or regulation
• Infringing on intellectual property rights of HytList or third parties
• Transmitting any harmful code, viruses, or malicious software
• Engaging in unauthorized framing or linking to the Service
• Uploading or transmitting spam, chain letters, or unsolicited communications
• Impersonating another user, person, or entity
• Interfering with or disrupting the Service or servers
• Attempting to bypass security measures or access restricted areas
• Collecting user information without consent
• Using the Service to harass, abuse, or harm others
• Reverse engineering, decompiling, or attempting to extract source code
• Scraping or harvesting data from the Service without permission

The Service may allow you to post, submit, or display content including server descriptions, comments, and other materials ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with operating and promoting the Service.

You represent and warrant that you own or have the necessary rights to all User Content you post, and that such content does not violate these Terms or any applicable laws.

We reserve the right, but are not obligated, to monitor, edit, or remove any User Content at our sole discretion.

The Service may contain links to third-party websites, servers, or services that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

By listing a server on our platform, we do not endorse or assume responsibility for the server's content, operation, or conduct. Users connect to listed servers at their own risk.

When you connect to a Hytale server listed on our Service, you are subject to that server's privacy practices and data collection, which are beyond our control.

You agree to defend, indemnify, and hold harmless HytList and its affiliates, officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content
• Any server you list on the Service

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may terminate your account at any time by contacting us at hello@hytlist.org.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which HytList operates, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and HytList concerning the Service and supersede all prior agreements and understandings.
